1. Who we areThis store is operated by Builders of the South LLC, 3501 Severn Ave, Suite 20K, Metairie, LA 70002. Phone (504) 329-7937, email info@buildersofthesouth.com. We sell products only.
2. Orders and acceptanceYour order is an offer to buy. We accept it when we charge your payment method and confirm the order. We may decline or cancel any order, for example because an item is out of stock, a price or description contains an error, or we suspect fraud. If we cancel an order after you paid, we return your payment in full.
3. Prices and pricing errorsAll prices are in US dollars. If a product is listed at a clearly wrong price, we may cancel the order and return your payment in full, or offer to complete it at the correct price.
4. Shipping and sales taxA flat shipping charge of $100 applies to each order. It is shown in your cart and at checkout before you pay. Sales tax is added to your order, including the shipping charge, at the rate shown at checkout.
5. Payment and financingPayments are processed by Stripe. Pay-over-time options such as Affirm and Klarna are offered by those companies, are subject to their approval and terms, and are not available to everyone. We are not a lender and do not control their decisions.
6. Returns and exchangesWe do not offer refunds. Exchanges are available within 14 days of delivery for items in the original package, unopened and unused, as described on our Returns & Exchanges page.
7. Products and warrantyProducts are sold new. Any manufacturer warranty is provided by the manufacturer under its own terms; see our Warranty information page. Brand names and photos shown belong to their owners, and we are an independent retailer, not affiliated with or endorsed by the manufacturers.
8. Disclaimer of other warrantiesTO THE FULLEST EXTENT ALLOWED BY LAW, EXCEPT FOR THE MANUFACTURER’S WARRANTY AND ANY WARRANTY THAT CANNOT BE EXCLUDED BY LAW, BUILDERS OF THE SOUTH LLC MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY AGAINST REDHIBITORY DEFECTS AND ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow certain exclusions, so this may not apply to you.
9. Limitation of liabilityTO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER IS LIMITED TO THE PRICE YOU PAID FOR THE PRODUCT, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. Nothing here limits liability that the law does not allow us to limit.
10. Governing law and venueThese terms and your order are governed by the laws of the State of Louisiana. Except for claims that must be arbitrated under section 11, the state and federal courts for Jefferson Parish, Louisiana have exclusive jurisdiction.
11. Resolving disputesPlease contact us first and give us 30 days to resolve a problem. If we cannot, any dispute will be decided by binding individual arbitration under the American Arbitration Association consumer rules, not in court, and you and we each waive the right to bring or join a class action. Either of us may instead bring an individual claim in small claims court. You may opt out of arbitration by emailing us within 30 days of your order.
12. ChangesWe may update these terms. The terms in effect when you place your order apply to that order.
